1. Heard the parties.

2. The petitioner has filed the present writ application being aggrieved by the order of suspension bearing Memo No. 475 dated 14.05.2025 issued by the Executive Officer, Nagar Panchayat, Musargharari. He further requests directions to accept his joining at Higher Secondary School, Bathua Buzurg from 01.01.2025, which has been unlawfully denied despite proper application and eligibility and directions for salary revision and pay fixation as an Exclusive Teacher, along with

Patna High Court CWJC No.11411 of 2025(2) dt.22-07-2025 2/2 release of his pending salary for December 2024. He also prays for all consequential service benefits due to him following the quashing of the impugned suspension order.

3. Learned counsel for the State submits that grievance of the petitioner can be raised before the District Appellate Authority constituted for deciding the claim of the teachers but the petitioner without approaching the District Appellate Authority has directly come before this Court.

4. Having considered the submissions made by the parties, this writ application is disposed with liberty to the petitioner to file an appeal before the District Appellate Authority.

5. If the appeal is filed within one month along with condonation of delay petition, the District Appellate Authority shall consider and dispose the same on its own merit within a reasonable time frame.
