JUSTICE ARUN KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 323, 341, 384 of the Indian Penal Code.

Allegation in brief is that the petitioner asked for extortion money otherwise he, threatened the construction of the house of the complainant, could not proceed further. Learned counsel for the petitioner submits that there is land dispute between the petitioner and the present complainant. The father of the petitioner has filed Title Suit aNo.194 of 2014 against the present complainant and others. He has no criminal

Patna High Court Cr.Misc. No.28870 of 2017 (2) dt.01-07-2017 2/2 antecedent except one case lodged by the witness of the present complainant and that case he is on bail as he is qualified person having M.Phill degree.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Zafar Khursheed be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Tr. No.575 of 2016 arising out of Complaint Case No.1922C of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
