The petitioner seeks bail in Sabour (Goradih) P.S. Case No. 186 of 2018 corresponding to Sessions Trial No. 113 of 2019, registered for the offences punishable under Sections 341, 323, 302, 504 and 34 of the Indian Penal Code and section 3/4 Prevention of Witchcraft Act.

As per prosecution case, petitioner is alleged to have given Khanti blow to the wife of informant, as a result of which, she died on the spot.

It is submitted by learned counsel appearing on behalf of petitioner that petitioner is innocent and has been falsely implicated in this case. Charge-sheet has already been submitted. Charges has been framed. Petitioner is in custody

Patna High Court CR. MISC. No.44195 of 2019(4) dt.16-10-2019 2/2 since 05.09.2018 having clean antecedent.

Considering the facts aforesaid and nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the bail application is dismissed.
