JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-10-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner apprehends his arrest in Industrial Area P.S. Case No. 173 of 2021, registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

14.250 litres of illicit liquor has been recovered from Scooty of this petitioner.

It is submitted that nothing has been recovered from conscious possession of this petitioner. The vehicle in question was being used for transporting illicit liquor without the knowledge and consent of petitioner. Petitioner claims clean antecedent.

Counsel for the State vehemently opposed the bail

Patna High Court CR. MISC. No.46168 of 2022(2) dt.21-10-2022 2/2 application and submitted that petitioner is registered owner of the vehicle in question from which illicit liquor was recovered. Considering the criminal antecedent, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
