This application for regular bail arises out of Special case No. 142 of 2020 arising out of Araria P.S. Case No. 95 of 2020, disclosing offence punishable under Section 30(a) of Bihar Prohibition & Excise Act, 2016.

The petitioner's prayer for regular bail was earlier rejected by an order dated 05.02.2021, passed in Cr. Misc. No. 35210 of 2020.

Learned counsel appearing on behalf of the petitioner has submitted that two other persons named in the F.I.R., namely, Prem Singh and Jasdeep Singh has been allowed regular bail by this Court by an order dated 04.02.2021 passed in Cr. Misc. No. 35702 of 2020 (Annexure-3).

Patna High Court CR. MISC. No.55692 of 2021(2) dt.24-11-2021 2/2 The petitioner is in custody since 04.02.2020. It has been stated in paragraph-3 of the application that the petitioner has no criminal antecedent.

Considering the facts and circumstances, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Araria in Special Case no. 142 of 2020 arising out of Araria P.S. Case No. 95 of 2020.
