The petitioners apprehend their arrest in Malsalami P.S. Case No. 246 of 2016 registered for the offences punishable under Sections 304(B), 201, 120(B) and 34 of the Indian Penal Code.
The informant alleged that his daughter was married to Dilip Rai five years ago but her husband and other in-laws were subjecting her to physical and mental torture due to nonfulfillment of demand of Rs. 1 lakh and a motorcycle. The accused persons killed his daughter on 16.09.2016.
Learned counsel for the petitioners submits that the petitioners are sister-in-law (Gotni) and married sister-in-law
Patna High Court Cr.Misc. No.29446 of 2017 (3) dt.19-08-2017 (Nanad) of the deceased. No specific allegation is made against the petitioners. The husband of the deceased is in custody. The dead body of the deceased was found in the river and there was no external injury.
Considering the facts aforesaid and nature of allegations made against the petitioners and the facts that the petitioners are sister-in-law (Gotni) and married sister-in-law (Nanad) of the deceased the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Patna City in Malsalami P.S. Case No. 246 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
