JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gadhpura P.S. Case No. 20 of 2018 registered for the offences punishable under Sections 341, 307, 506, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act and Sections 3/ 4 of the Explosive Substances Act. Prosecution story is that while the informant was coming some unknown miscreants started firing on the informant causing injury to him and he has suspected the hand of the petitioner saying that whenever the petitioner came at the hotel some occurrence took place, he say that the petitioner involved in the occurrence.

Submission of the learned counsel for the petitioner is that later on the name of the petitioner came in the occurrence on the confessional statement of co-accused. Except suspicion

Patna High Court CR. MISC. No.42351 of 2019(4) dt.11-09-2019 2/2 there is no allegation against the petitioner. None of the accused persons stated about firing by this petitioner and there is nothing to show that the petitioner has enmity with the informant from before.

In view of the above facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within two weeks from the receipt of the order be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Court below in connection with Gadhpura P.S. Case No. 20 of 2018 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned with further condition that he shall appear before the I.O. as when he is required and cooperate in the investigation, otherwise his bail bonds shall be cancelled.
