JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-06-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 420 and other ancillary sections of the Indian Penal Code.

Prosecution case is that the petitioner did not supply materials for which he had been given Rs.11,92,000/- through four cheques in connection with Nal Jal Yojna and thus misappropriated the said public money.

Learned counsel for the petitioner submits that as per the report of the BDO, Chand (Annexure 3) materials have already been supplied by the petitioner and work has been finished under the said scheme and thus no dues is pending against him. Petitioner has got no criminal antecedent. Considering the nature of allegation, prayer for bail of

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Kaimur at Bhabua in Chand Police Station Case No. 24 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
