The petitioners apprehend their arrest in connection with Sadar P.S. Case No. 198 of 2017 registered under Sections 272, 273 of the Indian Penal Code and 30(A) of the Bihar Prohibition and Excise Act.
Learned counsel appearing on behalf of the petitioners submits that petitioners have been made accused in this case only on the confessional statement of co-accused Suranjan Prasad Yadav. Further submission is that on perusal of seizure list, it appears that nothing has been recovered from the conscious possession of the petitioners.
Having considered the facts and circumstances of the
Patna High Court Cr.Misc. No.26666 of 2017 (2) dt.07-06-2017 2/2 case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cumSpecial Judge (Excise Act), Purnea in connection with Sadar P.S. Case No. 198 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
