JUSTICE BIRENDRA KUMAR ORAL ORDER 27-11-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341,323,376(D),420,307,379,34 of the Indian Penal Code.

Allegation against the petitioner is that he was known to the victim and he induced the victim to go with him for managing a job for the victim at Kishanganj. Allegation is that the victim followed the petitioner and at Kishanganj she was ravished by the petitioner as well as co-accused Bijay Kumar. The victim has supported the aforesaid allegation in her statement under Section 164 Cr.P.C.

At this stage, there is nothing to disbelieve the victim. Hence, I am not inclined to

Accordingly, prayer is refused.

Petitioner is directed to surrender within three weeks.
