2. The petitioner apprehends his arrest in a case registered for the offence under Section 379, 411 of the Indian Penal Code.
3. As per the prosecution case, police seized two tractors on the spot, which were loaded with illegal sand, causing loss of government money to the tune of Rs. 6,25,425/-.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case merely because he happens to be owner of one of the seized tractor. However, by filing supplementary, learned counsel for the petitioner submits that petitioner has already deposited a sum of Rs. 42,500/- in the concerned department by way of penalty for lifting sand by his tractor weighing 150 cft. sand. 5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Nalanda at Biharsharif in connection with Rahui P.S. Case No. 188 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
