Petitioner seeks bail in Jandaha P.S. Case No.01 of 2019 instituted for the offence under Section(s) 394 Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioner submits that petitioner is not named in the First Information Report.
In the written report, it is alleged that while informant was going on motorcycle, three miscreants from motorcycle tried to snatch his jewellery bag. One of the miscreants opened fire and succeeded in taking away the jewellery bag from the informant. The informant was taken to Laxmanpur Hospital by the villagers. The informant claimed to identify one of the miscreants as Tutul Kumar.
Patna High Court CR. MISC. No.42393 of 2019(2) dt.16-07-2019 2/2 Name of the petitioner has come during investigation in the statement of Tutul Kumar. Petitioner has been remanded in this case from Jandaha P.S. Case No.02 of 2019. There is no recovery of any article from possession of the petitioner. Petitioner is in custody since 04.05.2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-XI, Vaishali at Hajipur, in connection with Jandaha P.S. Case No.01 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
