The petitioner apprehends her arrest in a case registered for the offence under Sections 328, 302, 34 of the Indian Penal Code.

As per the prosecution case, all the F.I.R. named accused persons, including this petitioner, killed the sister of the informant by administering her poison due to non-fulfillment of demand of dowry.

It is submitted on behalf of petitioner that petitioner is mother-in-law of the deceased and there is general and omnibus allegation against her. She is separate in mess and property and has got no concern with the affairs of couple. In fact, due to petty family feud, a quarrel took place between husband and wife (deceased) and due to which, the deceased herself

Patna High Court CR. MISC. No.46199 of 2022(2) dt.06-12-2022 2/2 consumed poison and committed suicide. Doctor has not found any external injury on the person of deceased. Petitioner is aged about 60 years and suffering from several ailments. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Saharsa in connection with Sonbarsa Raj P.S.
