This application for grant of regular bail arises out of Hasanpur P.S. Case No.39 of 2023 registered for the offence punishable under Sections 25(1-B)a, 25(1-A), 25(1AA), 26(1), 26(2) and 35 of the Arms Act. 3.
The petitioner is said to be running away from a welding shop in which illegal trading of arms was going on.

The petitioner has clean antecedent. He is in custody since 21.02.2023. Similarly situated co-accused Md. Mumtaz Alam @ Munna and Md. Salim @ Vikky have been granted bail by a co-ordinate Bench of this Court vide order dated 04.08.2023 passed in Criminal Miscellaneous Nos. 46382
Patna High Court CR. MISC. No.52848 of 2023(2) dt.23-08-2023 2/2 of 2023 and 48098 of 2023.

Considering the aforesaid facts, this application is also allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Samastipur, in connection with Hasanpur P.S. Case No.39 of 2023.

This is also subject to the condition that the petitioner shall mark his presence in Muffasil Police Station, District- Munger on first Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner.
