This is the second attempt of the petitioner for grant of regular bail in connection with Danapur P.S. Case No.1065 of 2022 registered for the offence under Sections 457/380 of the Indian Penal Code.

Earlier, the bail of the petitioner was rejected vide order dated 27.02.2024 passed in Criminal Miscellaneous No.74944 of 2023.

Theft was committed from the flat of the informant. In the CCTV footage, the petitioner was seen leaving the place after committing theft.

The petitioner is in custody since 03.07.2023. 6.
A supplementary affidavit has been filed by
Patna High Court CR. MISC. No.61040 of 2024(5) dt.07-02-2025 2/3 learned counsel for the petitioner stating therein that in the event of petitioner being released on bail, he will stay outside Bihar. 7.
Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody of the petitioner as well as the averments made in the supplementary affidavit, this application for regular bail is allowed. 9.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- 1, Danapur, Patna, in connection with Danapur P.S. Case No.1065 of 2022, subject to the condition that he shall appear in the trial regularly either virtually or through his lawyer and shall cooperate in the trial. 10.
The petitioner, after grant of bail, will stay at the following address :- "Noor Jahan C/o Md. Intekhab Alam Habib Chowk, Malikpur P.S.- Baruipur, VTC- Mallikpur, P.O.- Malancha Mahinagar, Sub-District- Bahinagar, District- South Parganas West Bengal Pin- 700145"
11. The petitioner will mark his attendance at the
Patna High Court CR. MISC. No.61040 of 2024(5) dt.07-02-2025 3/3 Baruipur Police Station, District- South Parganas, West Bengal on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.

The petitioner will visit Bihar only on the date fixed in the trial as well as in other cases in which he is an accused and is required to visit the trial Court in Bihar. Before leaving West Bengal, the petitioner will inform the local police station about the case and the date and the period for which he is going to stay in Bihar to attend the cases.

Let a copy of this order be communicated to the Superintendent of Police, South Parganas (West Bengal) through FAX for its compliance forthwith.
