The petitioner seeks bail in Bhabua P.S. Case No. 112 of 2019, instituted for the offence under Section(s) 395 of the Indian Penal Code, Sections 25(1-b)a, 26 and 27 of the Arms Act.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. Petitioner has been arrested merely on suspicion. Thereafter, the police recorded his confessional statement. Petitioner is in custody since 12.3.2019.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.42373 of 2019(2) dt.15-07-2019 2/2 the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Bhabua P.S.
