JUSTICE SANJAY PRIYA ORAL ORDER 24-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Bihariganj P.S. Case No. 207 of 2016 instituted for the offence under Sections-465, 467, 468, 471, 472, 420, 120(b) of the Indian Penal Code. As per written report filed by District Programme Officer, Secondary Education, Madhepura, the managing committee of Udayanacharya Vidyakar Kavi Inter College, Karma have enrolled 555 students in Sessions-2015-17 without having affiliation which is not in accordance with law. It is further alleged that an inspection team was constituted by the District Magistrate, Madhepura which shows that the managing committee of the Udayanacharya Vidyakar Kavi Inter College, Karma have enrolled 555 students in Sessions 2015-17 without having affiliation. According to letter No. 306 dated 13-10-

No.29125 of 2017 (3) dt.24-07-2017 2016 of the BEO, Alamnagar, the alleged college is not situated under Alamnagar Block rather the same is situated under Udakishunganj Block and according to letter No. 505 dated 22-10-2016 of the BEO, Udakishunganj, the alleged college is not situated under the Block of Udakishunganj rather the same is situated under Bihariganj Block. The petitioner is said to be principal of the aforesaid college. In such circumstances, from the written report itself, It appears that the college was taking admission of the students without affiliation and the alleged college was shifting from place-to-place and block-to-block and students had been enrolled unauthorizedly and illegally on plain paper only.

Hence, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected. The petitioner is directed to surrender in the court below and seek regular bail, which will be considered on its own merit without being prejudiced by this order.
