2. In terms of order dated 07.11.2017, the Principal Secretary, Panchayati Raj Department is present and has filed his show cause.
3. Having gone through the averments made and the
Patna High Court CWJC No.15431 of 2015 (11) dt.23-11-2017 2/3 submissions made before the Court today and taking into consideration the apology tendered, the Court does not propose to proceed further on the issue.
4. Coming to the merits of the matter, in view of the materials on record and averments made in the pleadings, specially the counter affidavits, in the opinion of the Court, the matter is not required to be kept pending moreso, in view of the stand taken before the Court by the Principal Secretary as well as learned counsel for the State that whatever remaining dues are required to be paid to the petitioner, in light of the benefit of A.C.P. having been given to him by way of arrears etc. shall be paid by the District Magistrate, Saharsa within two weeks.
5. In view thereof, the writ petition stands disposed off with a direction to the respondent no. 3, to ensure that all the remaining dues, which are required to be paid to the petitioner, including difference amount of Encashment of Unutilized Earned Leave, Group Insurance and Gratuity etc. are paid to him within three weeks from the date of production of a copy of this order before the respondent no. 3. The petitioner shall further be at liberty to represent before the competent authority with regard to any of her grievances, relating to non payment of her entitlement, which shall be considered in accordance with law expeditiously.
