The petitioner apprehends his arrest in Bhargama P.S. Case No.305 of 2018 registered under Sections 420, 468, 471 and 34 of the Indian Penal Code and under section 7 of the E.C. Act and section 102, 103, 104 and 115 of the Trade Marks Act. The informant lodged the case against the driver and unknown persons on the allegation that the driver was carrying sub-standard seeds of wheat of Sriram Super 303. The driver disclosed that he loaded the bags of seeds from godown at Jyoti Cinema (Forgesganj) and he was going to Jadiya (Supaul) but in the meanwhile the driver of the vehicle and another unknown person manged to flee away.
Learned counsel for the petitioner submits that the petitioner is the driver of the vehicle. The petitioner had no
Patna High Court CR. MISC. No.43882 of 2019(2) dt.17-07-2019 2/2 knowledge about sub-standard seeds of wheat. He was simply loaded the bags of seeds on the order of person, who was sitting there for transportation.
Having considered the facts and the nature of allegation made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Bhargama P.S. Case No.305 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
