Petitioner is in custody in connection with Basantpur P.S. Case No. 285 of 2018 for the offence under section 272, 273, 308/34 of the Indian Penal Code and Section 30(a) and 41(1) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

In the instant case total 59.60 liters of liquor was seized from Laloo Mahto and not this petitioner. Learned counsel for the petitioner submits that petitioner has no concern with liquor seized by the police. The petitioner is in custody since 28.5.2019.

Considering the fact that petitioner has no criminal
