The petitioner seeks regular bail in connection with Laxmipur P.S. Case No. 128 of 2018, registered for the offence punishable under Section 395/34 of the Indian Penal Code.

The allegation is regarding unknown persons having arrived at the house of the informant and committed loot of various articles including utensil, jewellery etc. The learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R., no recovery has been made from his possession and no Test Identification Parade has been held in order to connect the petitioner with the alleged crime. It is further submitted that apart from the present case,

Patna High Court CR. MISC. No.42965 of 2019(3) dt.30-09-2019 2/2 though the petitioner is accused in two other cases, however, he is on bail in one of the said case. The petitioner is stated to be languishing in custody since 23.2.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jamui in connection with Laxmipur P.S.
