This is an application for grant of anticipatory bail in connection with Sikta P.S.Case No.26 of 2014 registered for the offence under Section 436of the IPC.

The informant has alleged that the petitioner and few others entered into the house and set her house on fire with intention to kill the entire family members.

Learned counsel for the petitioner submits that the matter was investigated and police finding no material against any of the accused, submitted final form on 20.05.2014. Thereafter the informant filed protest petition which was registered as complaint case. The court below took cognizance of offence against the

Patna High Court Cr.Misc. No.29327 of 2017 (2) dt.01-07-2017 petitioner and other co-accused on 06.01.2017. The other coaccused persons have been allowed anticipatory bail by a coordinate Bench of this Court vide Cr.Misc.No.19315 of 2017. The case of this petitioner stands on similar footing and so he deserves anticipatory bail.

The learned APP opposed the submissions.

In the facts and circumstances of the case, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Trial No.2974 of 2017 (Complaint Case No.1603-C/2014 (arising out of Sikta P.S.Case No.26 of 2014) on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manas Kumar, Judicial Magistrate, Ist Class, Bettiah (West-Champaran), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
