JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 02-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Joki Hat P.S. Case No.59 of 2017 registered under Sections 467, 468, 471, 420 and 409/34 of the Indian Penal Code. The accusation is that Green Scheme was executed in Jokihat Block for three village Panchayats, namely, Chakai, Kursel and Pachhiyari Pipra, for the financial year 2005-2006 and direction was issued to close the aforesaid scheme. Thereafter, on 15.09.2015, the then C.E.O.-cum-Deputy Development Commissioner, Araria, illegally gave Rs.22,50,000/- to the Secretary, Panahayat Samit, Jokihat and Rs.14,100/- to others but

According to the Register, as maintained by the Block Office, till 27.09.2016, Rs.88,140/- was not deposited by the members of the non Government Organization, Seemanchal Jan Kalyan Kendra, Kishanganj and D.W.T. but, later on, the same was deposited on 28.09.2016 at the D.R.D.A., Araria, without interest on the said amount for which Ramesh Jha, the then Block Development Officer, Jokihat, Md. Jawed Ahmad (petitioner), the then Nazir, and other accused, named in the F.I.R., were found guilty. Learned counsel for the petitioner submits that, admittedly, the petitioner was posted as Clerk in the Block Office, Jokihat and was the Incharge of Nazir till 26.03.2009 and, thereafter, the petitioner retired from service on 31.

05.2014, whereas the allegation of misappropriation of money, as alleged in the F.I.R., was allocated on 15.09.2015, as such, the petitioner is not responsible in any manner for the aforesaid misappropriation. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.
