JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 08-06-2017 Heard Mr. Uday Chand Prasad, learned counsel for the petitioners and Mr. Anuj Kumar Srivastava, learned A.P.P. for the State.

Petitioners were said to be lady members of the unlawful mob, are seeking anticipatory bail in connection with Sadar P.S. Case No. 230 of 2016 registered for offences under sections 341, 323, 384, 379, 504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that a land dispute is admitted and in the F.I.R. save and except that the petitioners are said to be members of the unlawful mob, there is no specific allegation of committing any overt act. Learned APP for the State submits that the petitioners

Patna High Court Cr.Misc. No.24614 of 2017 (2) dt.08-06-2017 2/2 were members of the unlawful mob and thus do not deserve the privilege of anticipatory bail.

Considering the nature of allegation, facts and circumstances of the case mentioned above, the petitioners, above named, in the event of arrest or surrender before the court below within a period of four weeks, be enlarged on bail on furnishing bail bond of Rs.10,000/-each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa/Successor Court in connection with Sadar P.S. Case No. 230 of 2016, subject to the condition as laid down under section 438 (2) of the Criminal Procedure Code.
