Heard learned counsel for the petitioner as also the learned counsel appearing for the State.

The petitioner is apprehending his arrest in connection with Rohtas (Dehri) Complaint Case No. 97 of 2015 for the offence under Sections 419, 420, 468, 504 and 506 of the Indian Penal Code. However, cognizance was taken under Section 406 of the IPC.

Learned counsel appearing for the petitioner submits that the petitioner has no criminal antecedent. He was an agent and in fact he was also the victim of the fraud played by the

Patna High Court Cr.Misc. No.48300 of 2018(4) dt.11-12-2018 2/2 Company. He refers to the documents contained in Annexure-2 series to contend that he has also deposited the amounts. Considering the totality of the fact and also the fact that the petitioner has no criminal antecedent, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Dehri, Rohtas in connection with Rohtas (Dehri) PS Case No. 97 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
