JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Sabour P.S. Case No. 183 of 2000 instituted for the offence under Sections 307, 324/34 of the Indian Penal Code and Section 27 of the Arms Act pending in the court of Chief Judicial Magistrate, Bhagalpur.
Counsel for the petitioner submits that police after investigation has submitted final form in the case. The cognizance has been taken against the petitioner for the offence under Section 307/34 Indian Penal Code and Section 27 of the Arms Act. There is no direct allegation against the petitioner of causing injury to anybody.
From the impugned order it appears that in the instant
Patna High Court Cr.Misc. No.45031 of 2018 (3) dt.08-08-2018 2/2 case cognizance has been taken on 6.9.2011. Petitioner did not appear and, thereafter, process under Section 82 Cr. P.C. has been issued against the petitioner.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail which will be considered by the court below in accordance with law without being prejudiced by this order, if possible on the same day.
