The petitioner is languishing in custody for the offence under Sections 498 (A) and 494/34 of the Indian Penal Code. Petitioner is husband of opposite party no. 2. Allegation is of demand of dowry and torture against the petitioner. Marriage was solemnized in the year 2009. After birth of a female child, husband allegedly married with another lady. Vide paragraph 9, petitioner has denied the allegation of marriage with any other lady and petitioner has stated that he is ready to have conjugal life with the complainant restored. Petitioner is in custody since 25.05.2019.
Considering the entire facts, let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below
Patna High Court CR. MISC. No.43343 of 2019(2) dt.16-07-2019 2/2 where the case is pending in connection with Buxar (Mahila) P.S. Case No. 04 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below having immovable property in his name.
(b) The petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall ensure within two months that the complainant is restored the conjugal life, failing which the court below would be at liberty to cancel the bail bond of the petitioner.
