This application for anticipatory bail arises out of Bathnaha P.S. Case No. 184 of 2018 for the offence punishable under Section 364 of the Indian Penal Code.

There are 10 persons named in the First Information Report including this petitioner, out of whom eight persons have been allowed anticipatory bail by this Court by an order dated 07.01.2019 passed in Cr. Misc. No. 70416 of 2018, copy of which has been brought on record by way of Annexure3 to this application. Learned counsel appearing on behalf of the petitioner appears to be correct in his submission that there is nothing to distinguish the petitioner's case with the case of those, who have been allowed privilege of anticipatory bail by this Court by the said order dated 07.01.2019.

Patna High Court CR. MISC. No.45539 of 2019(3) dt.30-09-2019 2/2 I find substance in the submission so advanced. This application is accordingly allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in Bathnaha P.S. Case No. 184 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
