The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioners who apprehend arrest in connection with Saharsa, Sadar P.S. Case No. 921 of 2025, lodged on 14/08/2025, under Sections 115(2), 126(2), 352, 76, 109, 303(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution, FIR has been lodged against five named accused persons including the present petitioners.

Patna High Court CR. MISC. No.47755 of 2026(2) dt.22-07-2026 2/3 Allegation has been made that the petitioners have assaulted the informant and his family members. Allegation of snatching gold chain is also there.

4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel submits that the actual dispute has been otherwise. Counsel submits that a group of persons have attacked on the petitioners for which they filed a case on 12/08/2025 bearing Saharsa Sadar P.S case No. 913 of 2025, when the informant and deceased received information that case has been lodged. Thereafter, with a view to save their skin, they have filed another false and fabricated case before the same police station bearing Saharsa Sadar P.S case No. 921 of 2025 on 14/08/2025. Counsel submits that the cause of dispute is that petitioner No.1 has settled in his sasural and the relatives of his sasural is not interested that he could settle and this is the basic cause due to which the dispute has arisen.

Counsel submits that the antecedent of petitioner No.1 is not clean as there is one criminal case pending against him in which he is on bail, but antecedent of petitioner No.2 and 3 is clean. Counsel further submits that petitioners are ready to fulfill all the conditions whatsoever shall be imposed upon them.

5. Learned APP for the State opposes the prayer for bail of the petitioners and fairly submits that from perusal of both the FIR, it transpires that the dispute took place with a view to keep the vehicle on the road.

6. As such, in the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of C.J.M, Sharsha, in connection with Saharsa Sadar P.S. Case No. 921 of 2025 subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
