JUSTICE PURNENDU SINGH ORAL ORDER 05-07-2023 Heard Mr. Shashi Shekhar Tiwary, learned counsel appearing on behalf of the petitioner, Mr. Madhaw Pd. Yadaw and Mr. Arvind Kumar, learned counsel appearing on behalf of the State and Mr. Deepak Kumar, learned counsel appearing on behalf of the University.

2. Learned counsel appearing on behalf of the petitioner inform this Court that on account of certain pensionary benefit dues has been paid to the petitioner.

Patna High Court CWJC No.12047 of 2022(4) dt.05-07-2023 2/3 However, till date petitioner has not been paid either on account of other pensionary dues including family pension due to the petitioner, who is wife of the deceased employee.

Considering the fact that petitioner is an old widow lady and she has been forced to file the present writ petition for payment of pensionary dues and other benefits relating to her husband and fixation of family pension, whose husband had died on 08.12.2016 in harness. It is admitted that as on date certain dues amount have been paid to the petitioner. However, substantial amount is still required to be paid. The Registrar of the University must forthwith ensure that the petitioner is paid all the retiral dues on different heads, which has not been paid till date within a period of three weeks. It must be take note that the husband of the petitioner had died in harness on 08.12.2016.

4. In case of failure to make payment within aforesaid period, the petitioner is at liberty to avail appropriate remedy to take legal action against the Registrar of the University.

5. With the above direction and observation the present writ petition is disposed of with liberty to the petitioner to take immediate measure in case of failure of payment on the part of the Registrar of the University.

6. If the matter is brought to the notice of this Court,
