JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 14-09-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 30(a), 32(ii) of the Bihar Prohibition & Excise Act.
There is recovery of 6600 pieces of cough syrup made of Wiscop Company from a pick-up van. The petitioner is driver of the pick-up van.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.47277 of 2023(4) dt.14-09-2023 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is only driver of the pick-up van and he has no concern with the seized articles. Moreover, the seized contraband is much below the commercial quantity. The petitioner is languishing in custody since 21.04.2023. Moreover, other co-accused has been granted bail by a coordinate Bench of this Court vide order dated 22.05.2023 passed in Cr. Misc. No. 32258 of 2023. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise-I, Begusarai in connection with Begusarai
