This is an appeal under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for anticipatory bail vide order dated 06.06.2018 in A.B.A. No. 525 of 2018 passed by the learned 1st Additional Sessions Judge-cum-Special Judge S.C./S.T. (POA) Act, Jamui in connection with Sikandra P.S. Case No. 207 of 2017 registered under Sections 302, 201, 120B of the Indian Penal Code as well as Sections 3(i)(r)/3(2), 5(a) of the SC/ST Act.

The FIR would reveal that only suspicion is there against the appellant and other co-accused persons of commission of murder of the son of the informant.

Patna High Court CR. APP (SJ) No.2299 of 2018 dt.09-08-2018 2/2 Co-accused Karmi Devi and others have been allowed regular bail by this Court vide order dated 16.04.2018 passed in Cr. Appeal (SJ) No. 897 of 2018.

In the event of surrender of the appellant and prayer for regular bail within three weeks from today, the prayer for regular bail shall be considered on the same day without being prejudiced by this order considering the fact that only material available is suspicion against the appellant.

With the aforesaid observation, this appeal stands disposed of.
