JUSTICE ARUN KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 279, 379, 307, 353, 427 of the Indian Penal Code, Section 4/40 of Bihar Minor Mining Act and Illegal Mining Transport Act 4/6/8.
Allegation in brief is that the informant-driver of the S.D.P.O. was chasing tractor loaded with illegal sand. While trying to overtake the tractor it hit vehicle by the side. Local people disclosed the name of the petitioner as a driver of the tractor.
Learned counsel for the petitioner submits that there is no material against the petitioner except the general allegation that some local people disclosed the name of the petitioner, even
Patna High Court Cr.Misc. No.29117 of 2017 (2) dt.01-07-2017 2/2 is no any name of specific person is not disclosed in the F.I.R. and this petitioner is neither driver nor the owner of any tractor. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Guddu Yadav be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Surajgarha P.S. Case No.42 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
