JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is seeking anticipatory bail in connection with Dumra P.S. Case No. 305/2018 registered under Sections 419, 420, 467, 468, 471, 120B of the Indian Penal Code.

As per allegations one Rohit Kumar was a candidate for appointment as Constable was called for the measurement of his chest. In course of measurement, it was found that there were some differences in the measurement when verified from the original file of said Rohit Kumar the photographs and the signature were also varying. It is alleged that said Rohit Kumar had disclosed that this petitioner had taken part in the selection process in place of Rohit Kumar.

Learned counsel for the petitioner submits that the allegations are false and flimsy and this petitioner has been

Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner, as according to him, the name of this petitioner has transpired in the statement of the applicant Rohit Kumar.

Considering the facts and circumstances of the case whereunder apart from the statement of the candidate Rohit Kumar no other material has been brought to the notice of this court to connect this petitioner for the present, let the above-named petitioner, in the event of his arrest/surrender before the court below within a period of four weeks, be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Dumra P.S.
