JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-06-2017 Heard Sri Upendra Yadav, learned counsel for the petitioners, and Sri Sanjay Kumar Singh, learned A.P.P. for the State.

The petitioners are seeking anticipatory bail in Kuchai Kot P.S. Case No. 56/2017 registered under Sections 147, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioners would submit that so far as the petitioner no. 1 is concerned, save and except that his presence has been said to be there at the place of occurrence there is no specific allegation of assault against him. The petitioner no. 2 is said to have assaulted the informant and caused injury. Learned A.P.P. opposed the prayer for anticipatory

In the facts and circumstances of the case stated herein-above, let the petitioner no. 1, namely, Timal Yadav, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. VII, Gopalganj in Kuchai Kot P.S. Case No. 56/2017, subject to the conditions under Section 438(2) of the Code of Criminal Procedure.

The prayer for anticipatory bail of the petitioner no. 2, namely, Amarjeet Yadav is rejected. If he surrenders within four weeks from today and prays for regular bail before the court below, the same would be considered on its own merit. (Rajeev Ranjan Prasad, J) Dilip, AR U T
