2. The earlier regular bail petition of the petitioner was rejected by this Court vide order dated 04.11.2022 in Cr. Misc. No. 41038 of 2022.

3. Learned senior counsel for the petitioner submits that the fresh ground for renewal of the bail application is that even after framing of the charges, not a single witness has been examined. In this respect, a report was called for from the court below which is available with the record which shows that there are nine charge-sheeted witnesses but not a single witness has been examined.

4. Considering the above-mentioned facts and

No.48336 of 2024(3) dt.23-08-2024 2/2 circumstances as well as the fact that the trial is going at snail pace, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge NDPS 1, Muzaffarpur in connection with Sahebganj P.S. Case No. 233 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) The petitioner shall remain present physically on each and every date before the court below. In case of failure on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bonds of the petitioner.
