2. The petitioner has preferred this application for grant of regular bail in connection with Taraiya P.S. Case No. 89 of 2025 dated 04.04.2025 registered for the offences punishable u/ss 317(2), 317(5), 318(4), 338, 336(3), 310(4) and 310(5) of the B.N.S. and Sections 25(1-B)(a), 26 and 35 of the Arms Act.
3. As per the prosecution case, on secret information, 5-6 miscreants were making preparation to commit crime then the informant along with the police personnel reached the place of occurrence. On seeing police, some miscreants started fleeing away but four miscreants were apprehended and they disclosed their name as Akash Kumar, Vikash Kumar, Ujwal Kumar,
Patna High Court CR. MISC. No.49246 of 2025(2) dt.18-08-2025 2/3 Sandeep Kumar @ Nanhe (petitioner) and they also disclosed the name of their assaociates as Ashok Singh and Deepak Kumar. On search, several incriminating articles and mobile phones were recovered from the apprehended accused persons. It is further alleged that one loaded country made pistol with live cartridges and one mobile phone were recovered from the possession of the petitioner.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery. The petitioner has three criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 05.04.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
Patna High Court CR. MISC. No.49246 of 2025(2) dt.18-08-2025 3/3 concerned, Saran at Chapra in connection with Taraiya P.S. Case No. 89 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
