Petitioners apprehend their arrest in Naya Ram Nagar (Safiyasarai) P.S. Case No.168/2016 registered for the alleged offences under Section 364-A and 307 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, the petitioners are said to have kidnapped the informant for a ransom of Rs.2 lakhs and they tried to drag him to river Ganga to dump him in it but, due to interference of the villagers, they could not do so and managed to escape by resorting firing.
It has been submitted by learned counsel for the petitioners that there is a disputing of fishing of fish between the father of the petitioners and the informant. Father of the
Patna High Court Cr.Misc. No.19375 of 2017 (03) dt.12-06-2017 - 2 - petitioners had filed number of complaints against the informant and his family members. In order to mount pressure to enter into a compromise in the said matters, the informant has filed this false and frivolous case against the petitioners. The petitioners have also filed documents in buttress of their aforesaid submissions Considering the facts aforesaid and the nature of allegation as made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000.00 (Rupees Ten Thousand) each with two sureties of like amount each to the satisfaction of learned A.C.J.M. 1st, Munger in Naya Ramnagar (Safiyasarai) P.S. Case No.168/16, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prakash Chandra Jaiswal, J.) Trivedi/- U T
