Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

Prosecution's case in short is that all the F.I.R. named accused persons including the petitioners and 15 to

Patna High Court CR. MISC. No.55247 of 2021(2) dt.27-06-2022 2/3 20 unknown persons armed with fire arms, bricks and stones came to the house of the informant and started assaulting them a result of which four persons from the informant side sustained injuries.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Allegation of firing is against co-accused Manish Kumar and so far as this petitioner is concerned, he is alleged to have assaulted the informant with butt of the pistol. Injuries caused to the informant have been found to be simple in nature. Present case is the counterblast of Tarapur Police Station Case No. 74/2020 in which father of the petitioner was killed by the informant side . Petitioners have got no criminal antecedent. Learned counsel appearing for the State opposes the prayer for bail.

Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate first class Munger in Sangrampur (Tetiya Bambar) Police Station Case No. 75/2020, subject to the
