====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-10-2024 Heard learned counsel for the petitioner, the State and informant.
2. Petitioner seeks bail in a case registered for the offence punishable under sections 304B/34 of the Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act.
3. It is a case of dowry death. Informant's daughter was married with the petitioner on 16.5.2023. Later on, petitioner and his family members started subjecting her to cruelty and harassment for non-fulfilment of demand of dowry. It is further alleged that on 22.4.2024 informant received information that his daughter was killed by the petitioner and his family members.
4. Learned counsel appearing for the petitioner submits that the petitioner is husband of the deceased who was a lady of hot temperament and she committed suicide on the
Patna High Court CR. MISC. No.48212 of 2024(3) dt.25-10-2024 2/2 trivial issue. Petitioner informed parents of deceased about her death. Thereafter, parents of deceased had also come and participated in the cremation. Petitioner is in custody since 24.4.2024.
5. Learned counsel for the State and informant oppose the prayer for bail. They submit that petitioner is the husband of the deceased and there is direct and specific allegation that he and his family members killed the deceased for non-fulfilment of dowry demand.
6. Considering the fact that the petitioner is husband of the deceased, who died in unnatural condition within seven years of marriage in her in-laws house, prayer for bail of the petitioner is rejected.
