JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2018 The petitioner is apprehending his arrest in connection with Mahkar P.S. Case No. 23 of 2016, registered for offences punishable under Sections 406, 409, 420 and 353 of the Indian Penal Code.

Petitioner happens to be Headmaster and allegation against him is that he swallowed an amount of Rs. 4,80,000/-, which was meant for construction of school building. It has been submitted on behalf of the petitioner that he has falsely been made accused in this and paragraph -95 of the case diary shows that he has completed the work till centering and he undertakes to do the remaining construction work. Heard learned A.P.P. also.

Having heard both sides, considering the facts and

No.49725 of 2018 (3) dt.19-09-2018 2/2 circumstances of the case, this application is disposed of with direction to the petitioner to surrender before the court below within a period of six weeks and the court below shall release the petitioner on provisional bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of like amount each to the satisfaction of ACJM -XI, Gaya, in connection with Mahkar P.S. Case No. 23 of 2016 for a period of three months, during which period the petitioner shall complete the remaining construction work and shall produce a work completion certificate and the court below after verifying the same shall confirm the provisional bail of the petitioner, otherwise, he is free to pass any order as he deems fit and proper.
