Heard learned counsel for the petitioners, learned GP-14, Shri Dhurjati Kumar Prasad and the learned counsel

Patna High Court CWJC No.1913 of 2021(3) dt.07-04-2025 2/2 appearing on behalf of the NHAI.

Learned counsel appearing on behalf of the NHAI submits that from perusal of Annexure-2 to the writ application, it would manifest that already arbitral award has been passed by the Arbitrator-cum-Additional Collector, Aurangabad in LA Case No. 205 of 2016-17. It is next submitted that since Arbitrator has already adjudicated the case and in the event if the petitioners are aggrieved by the said award, they have remedy to resort to in accordance with law under the Arbitration Act. It is further submitted by the learned counsel appearing on behalf of the NHAI that prior to the Commissioner being appointed as Arbitrator, the arbitration was being done by the Additional Collector. 3.

At this stage, learned counsel appearing on behalf of the petitioners seeks permission to withdraw the writ application with liberty to the petitioners to avail their alternative remedy in accordance with law.

Permission is accorded.

Accordingly, the instant writ application is dismissed as withdrawn with the aforesaid liberty.
