The petitioner seeks bail in connection with Durgawati P.S. Case No. 325 of 2023 instituted for the offence under Sections 354(D), 506, 509 & 34 of the Indian Penal Code and Sections 8/11 of the POCSO Act.

As per prosecution case, it is alleged that coaccused, Ankit Goswami used to harass the informant's minor

Patna High Court CR. MISC. No.46007 of 2025(5) dt.03-11-2025 2/3 daughter while she was going to school and this petitioner used to help him in such activities.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.05.2025. Petitioner bears no criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. From perusal of the FIR, it would manifest that there is no specific allegation attributed to the petitioner, rather the same is against co-accused person, namely, Ankit Goswami. It is submitted that allegation against the petitioner is general and omnibus in nature. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no specific allegation against the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing

Patna High Court CR. MISC. No.46007 of 2025(5) dt.03-11-2025 3/3 bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Durgawati P.S. Case No. 325 of 2023.
