====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 08-12-2021 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

The counter affidavit filed on behalf of the S.P., Gaya is rejected. He has filed to explain the fact that why the test identification parade of the accused persons, who were arrested, was not held. He is directed to file again a fresh counter affidavit explaining the same.

List this case on 15.12.2021.

This application, for grant of anticipatory bail, arises out of Delha Police Station Case No. 183 of 2020 (G.R. No.3994/20), disclosing offences under Section 392 of the Indian Penal Code.

The learned counsel for the petitioner submits that he has been named in the confessional statement of the co-

He submits that the entire life of the petitioner will spoiled when he sent to jail on the basis of confessional statement and he has annexed his education certificates as well as admit cards for appearing in various competitive examination.

Considering the aforesaid fact, prayer for anticipatory bail is allowed.

Let the petitioner, named above, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Additional District & Sessions Judge-X, Gaya, in connection with Delha Police Station Case No. 183 of 2020 (G.R. No.3994/20), subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition that the petitioner shall cooperate in the investigation.
