JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-03-2021 The present writ petition has been filed seeking the following reliefs:- "(i) For issuance of writ in the nature of Mandamus commanding the Respondent Authority to make payment of the petitioner's dues to the tune of Rs. 14,07,309/- (Rs. Fourteen Lakh, seven thousand, three hundred and nine only), along with appropriate interest for the services provided by it with respect to digitalisation of surveyed BPL family's data collected in the year 2007 and 2009 for the district of Muzaffarpur done in compliance to the order of the Deputy Development Commissioner for District Rural Development Agency, Muzaffarpur, as

At the outset, the learned counsel for the petitioner submits that the petitioner would be approaching the respondent no. 4 i.e. the Deputy Development Commissioner, District Rural Development Agency, Muzaffarpur in connection with payment of the admitted outstanding dues pertaining to the data management services provided to the respondents in compliance of the order issued by the Deputy Development Commissioner, District Rural Development Agency, Muzaffarpur dated 27.07.2009, hence the respondent no. 4 be directed to pay the admitted outstanding dues within a stipulated time frame.

Having regard to the submissions made by the learned counsel for the parties, I deem it fit and proper to disposes off the present writ petition with liberty to the petitioner to approach the Deputy Development Commissioner, District Rural Development Agency, Muzaffarpur for payment of the aforesaid admitted outstanding dues and in case appropriate representation is filed within a period of four weeks from today, the same shall be disposed off within a period of eight weeks, thereafter and in case any admitted outstanding dues are found payable, the same shall also be paid within a further period of four weeks thereupon, failing which the same shall carry an interest @ of 6

Patna High Court CWJC No.2044 of 2021(2) dt.25-03-2021 3/3 per cent per annum, from the date the same became due up to the date of actual payment.

It is needless to state that henceforth, the petitioner shall not be at liberty to take recourse to the remedy available under Article 226 of the Constitution of India, with regard to the subject matter of the present case.
