The petitioner apprehends his arrest in connection with Teghra P.S. Case No.31 of 2022 instituted under Sections 341,323,379,387/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution story, the informant alleged that as it was undertaking the work of transmission line accused persons resorted to indiscriminate firing and also demanded Rs.5,00,000/- from the contractor further threatening them of dire consequences. Accordingly, the FIR was lodged.

Learned counsel for the petitioner submits that there is omnibus allegation against him and further he do not have criminal antecedent and is ready to abide by all the terms and conditions put forward if granted the relief. He further submits that the petitioner is ready leave the district of Begusarai for three months.

No.46622 of 2022(2) dt.04-01-2023 2/2 Learned APP on the other hand opposes the prayer for anticipatory bail stating that it has become habit of the accused persons to threaten the contractors working by demanding extortion. Taking into account the fact that there is omnibus allegation against the petitioner, he do not have criminal antecedent as stated in para-3 and is ready to leave the district for three months, this Court is inclined to grant him relief.

Let the petitioner be released on bail, in the event of his arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Teghra P.S. Case No.31 of 2022 to the satisfaction of learned Chief Judicial Magistrate, Begusarai, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. with further direction to leave the District of Begusarai for three months and report to the Teghra Police Station after return to the district for next three months every fortnight.
