2. Petitioner apprehends arrest in a case registered for the offence punishable under section 21 (C) of the NDPS Act. 3 . As per the prosecution case , 80 litres illicit cough syrup have been recovered from the house of one Jai Prakash Sharma who disclosed that this petitioner has taken the alleged room on rent.
4. It is submitted that petitioner has been made accused in this case only on suspicion . The house from where the alleged recovery was made does not belong to this petitioner rather it belongs to one Jai Prakash Sharma . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the
Patna High Court CR. MISC. No.49279 of 2024(2) dt.08-08-2024 2/2 aforesaid recovery. Petitioner is student and claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Session Judge cum - Special Judge NDPS Araria in connection with Forbesganj P.S. case No. 115 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
