The petitioners apprehend their arrest in connection with Bagaha (Patkhauli) P.S. Case No. 132 of 2018 registered under Sections 436, 506 and 429/34 of the Indian Penal Code. The accusation is that, in the night of 31.03.2018, when informant, Rita Devi, and her mother-in-law woke up then saw that her house was burning then they come out from house anyhow and also saw that Sanjay Sahni, Munni Devi and Rina Devi were getting happy. On raising alarm, villagers reached there and tried to extinguish the fire but the house of the informant was burnt and household articles, ornaments and cash
Patna High Court Cr.Misc. No.50030 of 2018(3) dt.20-09-2018 2/2 of Rs.2,00,000/- were burnt to ashes.
Learned counsel for the petitioners submits that it would appear from the F.I.R. that petitioner nos. 1 and 2 are Gotni and niece of the informant and they have falsely been implicated in this case mere on suspicion. Further submission is that both petitioners being lady have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M. -I, Bgaha, West Champaran, in connection with Bagaha (Patkhauli) P.S. Case No. 132 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
