The petitioner seeks bail in anticipation of his arrest in connection with Chenari P.S. Case No. 52 of 2019, dated 27.02.2019, instituted for the offence under Section 379 of the Indian Penal Code.

The accusation in the F.I.R. is that the battery of Airtel Tower was pilfered by the unknown miscreants. Later,

Patna High Court CR. MISC. No.1809 of 2021(2) dt.14-07-2021 2/2 the driver of the vehicle belonging to the petitioner was apprehended, who disclosed that without the knowledge of the owner (the petitioner), such battery was used in the car which stands in the name of the petitioner.

Regard being had to the nature of accusation, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sasaram, Rohtas in connection with Chenari P.S. Case No. 52 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
