2. The petitioner seek anticipatory bail in connection with Dhanarua P.S. Case No. 158 of 2026, dated 03.06.2025, registered for the offences under Section 115(2), 126(2), 109(1), 117(2), 351(2), 352 of the B.N.S.
3. The case of the prosecution, in short is that the informant's son, namely, Sahil Kumar, was on his way when the accused persons and the petitioner assaulted him. Upon hearing the shout, the informant rushed to rescue his son, whereupon the accused persons attacked him as well. It is alleged that accused namely, Deepak Kumar and Munna Kumar, snatched Rs. 6,000/- and along with other co-accused persons, indiscriminately assaulted them with lathis with the intention to kill, causing a head injury and a fracture to the right hand.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. It is further submitted that the allegations are general and omnibus in nature, and there is no specific overt act or allegation attributed against the petitioner in the entirety of the incident. The petitioner is stated to be an elderly person having clean antecedents.
4. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail.
5. Having heard the rival submissions of the parties and considering the facts and circumstances of the case, let the petitioner above-named, in the event of arrest or surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Masaurhi, Patna/concerned court, in connection with Dhanarua P.S. Case No. 158 of 2026, subject to the conditions laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS). (Ranjan Kumar Jha, J) rashmi/- U T
